These Terms and Conditions govern your use of criticalfactors.io and any products or services purchased through this site. By accessing this site or purchasing any product or service, you agree to be bound by these terms.
Kinney Group LLC offers the following services through criticalfactors.io:
The Structural Exposure Diagnostic ($1,500) — a written structural diagnostic across four foundational domains, delivered within 48 hours of intake completion.
The Structural Exposure Blueprint ($3,500) — a prescriptive roadmap addressing the four domains surfaced in the Structural Exposure Diagnostic. Separate engagement. Requires prior completion of the Structural Exposure Diagnostic.
The Critical Factors Diagnostic ($7,500) — a written structural diagnostic across all ten domains of the Critical Factors Management System, delivered within 5–7 business days of intake completion.
The Critical Factors Blueprint ($15,000–$20,000) — a prescriptive roadmap addressing all ten structural domains. Separate engagement. Requires prior completion of The Critical Factors Diagnostic.
The Critical Factors Operating System ($25,000–$50,000) — full build-out and installation of the Critical Factors Management System inside the client organization. Clients who have completed The Critical Factors Blueprint may apply that fee toward The Critical Factors Operating System.
Retainer ($2,500–$5,000/month) — ongoing structural oversight following implementation of The Critical Factors Operating System.
All services are delivered digitally or on-site as specified per engagement. Physical product delivery is not applicable.
All payments are processed securely through Stripe. By completing a purchase, you agree to Stripe’s terms of service. We do not store payment card information on our systems. Diagnostic services require payment prior to intake. No work begins until payment is confirmed.
All diagnostic reports produced by Kinney Group LLC are structural clarity instruments derived exclusively from client responses to the Critical Factors intake questionnaire. Reports present structural findings and observations only. They do not contain recommendations, implementation steps, advisory content, or consulting of any kind.
Diagnostic reports are not a substitute for legal, financial, accounting, or professional business advice. Findings are based solely on the information provided in the intake. Kinney Group LLC makes no guarantees regarding specific business outcomes resulting from any report or engagement.
All diagnostic reports are classified as confidential and are intended solely for the executive use of the purchasing party. Kinney Group LLC treats all client intake information and report contents as confidential and does not share client-specific information with third parties, except where the client has explicitly authorized sharing with a partner advisor through the intake authorization checkbox.
Partners who deliver diagnostic services through the criticalfactors.io partner program are bound by a separate partner agreement governing the terms of their engagement, payment obligations, and use of the Critical Factors Management System methodology. Public partner program terms are described at criticalfactors.io/partners. Participation in the partner program is subject to qualification and approval by Kinney Group LLC.
Given the nature of professional diagnostic services, all sales are final. If the Structural Exposure Diagnostic has not yet been delivered and you wish to cancel, contact us at david@thekinneygroup.com within 24 hours of purchase and we will issue a full refund. No refunds are available once the diagnostic report has been delivered.
For Blueprint, Operating System, and retainer engagements, refund terms are governed by the signed engagement agreement for that service.
All content on this site — including the Critical Factors Management System framework, diagnostic instruments, report formats, the five-step CFMS cycle, written materials, and all associated methodology — is the proprietary intellectual property of Kinney Group LLC. No portion of any report, methodology, or content may be reproduced, distributed, or repurposed without express written permission.
To the fullest extent permitted by law, Kinney Group LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this site or any product or service purchased through it. Our total liability for any claim shall not exceed the amount paid for the specific product or service giving rise to the claim.
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the site following any changes constitutes acceptance of the revised terms.
